Agreement Overview

These Terms of Service ("Terms") constitute a legally binding agreement between you and Custom Cabinets Brampton ("Company," "we," "us," "our"). By requesting a free estimate, engaging our services, or visiting our website, you agree to be bound by these Terms. If you do not agree with any portion of these Terms, you should not use our services.

Service Description

Custom Cabinets Brampton provides custom cabinetry design, fabrication, and installation services for residential and commercial customers in Brampton and the Greater Toronto Area. Our services include in-home consultation, design, material selection, fabrication, and professional installation.

Free Estimates

We provide free in-home estimates to prospective customers. Estimates are valid for 30 days from the date of issue. Acceptance of an estimate by the customer constitutes agreement to proceed with the project under the terms outlined in the estimate and these Terms of Service.

Payment Terms

Payment Schedule

Payment for custom cabinet services is typically structured as follows: 50% deposit upon project commencement, and the remaining 50% due upon completion and installation. Alternative payment arrangements may be negotiated and must be agreed to in writing.

Accepted Payment Methods

We accept cash, cheques, e-transfers, and credit cards. Payment for custom orders must be received before fabrication begins unless other arrangements have been agreed to in writing.

Late Payment

Payments not received by the agreed-upon date are considered overdue. Late payments may result in suspension of services and may incur interest charges at a rate of 2% per month on the outstanding balance, or as permitted by law.

Design and Specifications

We will work with you to design custom cabinetry that meets your requirements and preferences. Designs are based on measurements, photos, and information provided by the customer. The customer is responsible for ensuring that the space and conditions we are designing for are accurately represented. Any discrepancies discovered during fabrication or installation due to inaccurate information may result in additional charges.

Warranty

Craftsmanship Warranty

Custom Cabinets Brampton warrants all cabinetry to be free from defects in materials and workmanship for a period of two years from the date of installation. This warranty covers structural integrity, joinery, finishes, and hardware operation.

Warranty Exclusions

The warranty does not cover: damage caused by improper installation, misuse, or lack of maintenance; damage resulting from water, humidity, or environmental factors beyond our control; normal wear and tear; damage from accidents or household pests; or damage caused by third-party modifications or repairs.

Warranty Claims

To file a warranty claim, contact us within the warranty period with details and photos of the issue. We will arrange to inspect the cabinetry and determine whether the claim is covered. If covered, we will repair or replace the defective component at no cost to you.

Cancellation and Refunds

Project Cancellation

If a project is cancelled after an estimate has been provided but before fabrication begins, the customer forfeits the design fee (typically $500-$1000, depending on design complexity). If cancellation occurs after fabrication has commenced, the customer is responsible for the full cost of materials and labour incurred to date, plus any applicable penalties.

Modification and Delays

Changes to a project after fabrication has begun may result in additional costs and delays. All change orders must be agreed to in writing and signed by both parties before proceeding.

Installation and Site Responsibility

The customer is responsible for ensuring that the installation site is prepared and ready (e.g., drywall finished, flooring complete, utilities accessible). The customer must provide safe access to the project area. If the site is not adequately prepared, we reserve the right to delay installation and charge for additional labour. The customer is responsible for any damage to floors, walls, or existing structures caused by the customer, other tradespeople, or environmental factors.

Liability Limitations

Custom Cabinets Brampton shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the provision of services, including but not limited to loss of profits, loss of use, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability under these Terms shall not exceed the amount paid or payable by the customer for the services that gave rise to the claim. Some jurisdictions do not permit the limitation or exclusion of liability, so some of these limitations may not apply to you.

Intellectual Property

All designs, drawings, specifications, and custom creations produced by Custom Cabinets Brampton remain our intellectual property unless otherwise agreed to in writing. You may not reproduce, distribute, or use our designs for purposes other than your own custom cabinet project without written permission.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Ontario.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after any such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
